The Board of Adjustment (BOA) holds quasi-judicial public hearings to determine requests made by property owners in the City and County of Durham for minor and custodial care special use permits, variances, and appeals of administrative interpretations or decisions, as authorized by State law and local ordinance. BOA is comprised of ten members appointed by the Durham City Council and the Board of Commissioners. BOA typically meets on the fourth Tuesday of every month at 8:30 a.m. in the Committee Room on the second floor of City Hall.
The board consists of seven members and three alternates. The Durham City Council appoints four members and one alternate. All must reside within the corporate city limits. City and County taxes must not reflect any delinquency at the time of submission of the application. The Board of County Commissioners appoints three members and two alternates of whom at least three must reside outside the city limits.
Applicants must be willing to set aside one day a month to serve. Members serve without compensation.
